Accommodation Clause
Article 1. Applicable Range
  1. The accommodation clauses and related agreements that our hotel concludes shall be pursuant to this Accommodation Clause, and any matters not stipulated herein shall be pursuant to the relevant laws, regulations, and custom.
  2. Irrespective of the above clause, our hotel shall be able to conclude special agreements within the range consistent with the purpose of the Accommodation Clause, laws, and customs.
  3. Our hotel shall not provide service other than for accommodation.
Article 2. Refusal of Accommodation
Our hotel may refuse to accommodate you in the following cases;
Your reservation does not comply with this clause.
Full house and no room is available
It is deemed by us that the guest may possibly conduct acts against the laws, regulation, peaceful public order, or immoral acts.
It is deemed that the guest suffers from an infectious disease.
Some special burden is required for the guest's accommodation.
We are unable to accommodate the guest due to a natural disaster, breakdown of our facilities, or any other unavoidable causes.
It is deemed that the guest is intoxicated and may cause annoyance to our neighborhood or speak/ behave in such manner as to cause annoyance to the other guests.
If the guest brings in hazardous items (firearms, a stove, petroleum) or goods hazardous to people's health.
Any enforcement ordinance according to Article 5 of the Kyoto Hotel and Ryokan Management Law that applies.
If the guest to whom Article 11 has applied in the past
Article 3. Notification of Name, etc.
  1. A person applying for accommodation at our hotel must present the following information to us.
    The guest's address, name, tel. No., gender, nationality, and occupation.
    Accommodation date, arrival time, company name, tel. No. and name of the applicant
    Accommodation charge
    Other information that the hotel deems necessary
  2. When the guest requests an extension of the accommodation exceeding the dates specified in above item 2, but no reservation was made, and such request is made, our hotel may accept it subject to advance payment, and such accommodation request is deemed suitable for processing.
Article 4. Formation of the Accommodation Contract etc.
  1. An accommodation contract is deemed formed when our hotel accepts the request in Article 3 herein and has confirmed the credit card payment, however, this shall not apply when our hotel proves that no acceptance has been given.
  2. Application money shall be applied for the accommodation charges to be paid by the guest, and if cases occur that Article 5 herein applies, the application money shall be used as a penalty and then for compensation and any remaining balance for refund to the guest, if any.
  3. If the application money above is not paid by the date specified by our hotel, such reservation request shall be cancelled.
Article 5. Special agreement not requiring payment of application money
  1. Irrespective of above Item 2, our hotel may make a special agreement where no payment of application money is required after conclusion of the accommodation contract.
  2. Upon accepting the accommodation contract, our hotel deems that we have agreed to a special agreement when our hotel did not require payment of application money or did not specify the payment date of such application money.
Article 6. The Guest's Right of Cancellation
  1. A hotel guest may cancel the reservation by applying to our hotel.
  2. If the guest cancels the whole or part of an accommodation contract due to reasons attributable to the guest (the case that our hotel specified the payment date of the application money for payment based on Article 4.2, but excluding the case that the guest cancelled the reservation before such payment), our hotel shall accept the penalty based on Annex item 1. However, if our hotel accepted a special agreement based on Article 5.1, such obligation to repay the application money shall be required only when our hotel has notified the guest of such obligation for cancellation of the reservation by the guest.
  3. If the guest does not arrive without notification to us by 8:00pm of the arrival date (if the arrival time is notified in advance, within two hours after such time), our hotel may deem such reservation as cancelled by the guest.
  4. In the above case of cancellation, if the guest is able to prove that the reason for the guest not having arrived without notice was non-arrival or delay in public transportation such as trains, airlines, etc. or other reasons not articulable to the guest, our hotel shall not require the penalty as in Item 1 herein.
Note 1. % indicates the ratio of penalty amount to the accommodation charge for one day (multiplied by number of guests)
Note 2. If the number of days in the contract is reduced, we shall charge a penalty for one day (the first day) irrespective of the number of days cut.

Article 7. Our hotel's right of cancellation
  1. Our hotel shall be able to cancel the reservation in the following cases, excluding other cases stipulated elsewhere.
    It is deemed possible by our hotel that the guest may conduct acts against the laws, regulations, or peaceful public order, or may commit immoral acts, or the guest has done so previously.
    If the guest is deemed clearly to be suffering from an infectious disease
    When unreasonable demands are made in a violent manner or a burden beyond the reasonable limit is required.
    Unable to accommodate due to Force Majeure, e.g. natural disaster etc.
    Any enforcement ordinance in Article 5 of the Kyoto Hotel and Ryokan Management Law may apply.
    If the guest does not comply with the rules regarding prohibited acts in the terms of use of our hotel, such as smoking in bed or hacking of the firefighting equipment (limited to items required for fire prevention).
    If the guest is a gangster or a member of an organized time group or other antisocial forces.
    If the guest is a corporation or other group controlled by gangsters or members of an organized group.
    If the guest is a corporation and its directors include persons who are classified as gangsters.
  2. When the guest cancels the reservation based on the above stipulations, our hotel shall not require charges such as service fees for which the guest has not been provided .
Article 8. Registration of Accommodation
  1. The guest must register the following information at the hotel on the first day of stay.
    The guest's name, address, occupation, and ID number
    If not Japanese, nationality and passport number
    Departure date and time
    Other information that our hotel deems necessary
  2. If the guest is to pay the charges in Article 12 herein using traveller's checks, coupons, credit cards, etc. instead of cash, you must notify us in advance at the above registration.
Article 9. Time of use of the guest room
  1. Our guest can use the room from 3:00pm to 11:00am next morning. However, if you are staying multiple days, you can use your room all day except on the arrival day and the day of departure.
  2. Irrespective of the above, we may allow our guest to use the room outside time shown above. In such cases, we will charge the following additional charges. Also, if extended use of the room after the checkout time is clearly indicated, we may also charge as follows.
    1,100 Yen per hour after the checkout time (inclusive of tax)
    Full amount of the normal room charge after 5:00pm
Article 10. Compliance with the terms of use
Any requests when staying in our hotel must comply with the terms of use displayed in the hotel.
Article 11. Refusal of Continuation of Stay
Our hotel may refuse continuation of stay in the following cases even during the agreed stay period.
If you bring a person other than the hotel's guest into your room
If you are subject to items 3 to 8 of Article 2
If you do not comply with the terms of use herein
Article 12. Payment of Charges
  1. Payment of the hotel charges shall be made in cash (Yen) or by credit card on arrival or whenever we request such payment.
  2. We shall request payment of the hotel charges even when we provide a room to our guest and made it available and then the guest did not stay at his/her will.
Article 13. Our hotel's Responsibility
  1. Our hotel's responsibility shall commence when the guest made the accommodation registration at our hotel or entered the guest room, whichever is earlier and ends when the guest checks out for departure.
  2. If our hotel damages our guest due to non-performance of the accommodation contract, related agreements, or by an illegal act, we shall compensate up to the maximum amount of 100,000Yen unless it was due to our hotel's wilful or gross negligence.
  3. Our hotel has taken out innkeeper's liability insurance to cover such damages to our guests, but if it falls under the disclaimer of the insurance the damages caused to our guest may not be fully covered.
Article 14. Rules for cases where we are unable to provide a guest room under reservation
  1. If our hotel is unable to provide the guest room agreed herein, we shall make our best effort to provide another hotel room under similar conditions.
  2. If our hotel is unable to provide a replacement room in another hotel as above, we shall pay the guest compensation equivalent to the penalty charge which shall be applied to the compensation. However, we shall not pay such compensation when there is no reason attributable to our hotel regarding the inability for provide a guest room.
Article 15. Handling of Bailed Items
  1. Our hotel shall not accept any items bailed by hotel guests.
  2. Our hotel shall not be held responsible for damages, i.e. loss or breakage of goods, cash or jewellery that the guest brought into the hotel ,unless such is due to our hotel's wilful or gross negligence.
Article 16. Storage of a Guest's Luggage or Belongings
  1. We shall not handle receipt or storage of a guest's luggage prior to arrival.
  2. Any items of a guest's hand luggage or belongings left behind after checkout, we shall store them for seven days including the day of discovery, report any jewellery if any to the nearest police station, and dispose of other goods at our discretion.
Article 17. Car Park
 Our hotel does not have a guest car park.
Article 18. The Guest's Responsibility
  1. If any damage is caused to our hotel due to reasons attributable to our guest, such guest must compensate our hotel for such damages.
  2. Storage of guests' luggage and belongings must be controlled by the guests. Our hotel shall not be responsible for any loss or damage caused to guests' luggage and belongings.
Article 19. Use of the Computer Communication System
  1. Use of computer communication in our hotel shall be carried out at the users' responsibility. Our hotel shall not be responsible for any damages caused to the user due to the service's shut down caused by a system failure or other reasons.
  2. If our hotel deems that some damage may be caused or caused to our hotel or a third party by inappropriate acts of the guest in the guest's use of computer communication, we shall be compensated accordingly.
Article 20. Jurisdiction and the Governing Law
Any dispute that may arise in relation to this contract shall be resolved by the Kyoto District Court and Kyoto Summary Court in accordance with the laws of Japan.
Article 21. Changes to this Contract
Regarding any matters not stipulated herein or deemed necessary for our operations, we may change the content herein without an advance notice.
