MACHIYA STAY KYO MIYABI｜Privacy policy

Machiya Stay Kyo Miyabi (the hotel) shall provide privacy policy ("our policy") as follows regarding the handling of privacy data in the services provided on our web site ("our services").

Article 1. Privacy data

"Personal data" in privacy information means "personal information" according to the Personal Information Protection Law and the data is of a living individual and by which a specific individual can be identified, such as the name, birth date, address, tel. No., contact details, etc.
"History and specific information" in privacy data means information other than the above "private data" consisting of, e.g. services used, products purchased, history of pages and advertisements seen, search key words used by a user, date/ time of use, method of use, postal code, gender, occupation, age, IP address of the user, cookie data, position data, device identification data, etc.

Article 2. Collection method of privacy data

Our hotel may ask for privacy data upon registration of a hotel guest, e.g. name, birth date, address, tel. No., mail address, bank account No., credit card No., driving license No., passport No. etc. We may also collect transaction records of the user and our business partners including privacy data and data relating to settlement (including information source, advertiser, advertisement delivery target "our business partner").
Our hotel may collect history/ characteristic information, e.g. services used, products purchased, history of pages and advertisements seen, search key words used by a user, date/ time of use, method of use, use environment (including transmission status of portable terminals if in use, and various setup data for use), IP address, cookie data, position data, terminal identification data when the user uses the services of our hotel or our business partners, or when viewing web pages.

Article 3. Purpose of collection/ use of privacy data

Purpose of our hotel's collection/ use of privacy data is as follows.

①	To display the registered information, e.g. name, address, contact details, payment method, service used, products purchased, payment thereof, etc. to let the user view, revise or view the usage status of his/ her own personal data
②	To use contact details, e.g. name and address to provide notices and contact the user and send merchandise or contact as necessary
③	To use information to verify the identification of the user, e.g. name, birth date, address, tel. No., bank account No., credit card No., driving license No., passport No., delivery data of registered mail, etc.
④	To use payment related information for invoicing the user, e.g. products name/ quantity purchased, type/ period of services used, frequency of use, invoice amount, name, address, bank account No., credit card No.
⑤	To display registered data on the screen or to transfer data to other services (including those provided by our business partners) based on the user's instruction to let the user input data easily
⑥	To use information to specify individuals, e.g. use status, name and address to refuse usage of a user who violates the terms of use herein or uses the service for improper purposes, such as delaying payment of charges or causing damage to a third party, etc.
⑦	To use information necessary for our hotel to provide the services, e.g. content of enquiries and data related to invoicing, service use status by the user, and contact details etc. to respond to enquiries by the users
⑧	Other purposes accompanying the above purposes for use

Article 4. Provision of personal data to a third party

Our hotel shall not provide any personal data to a third party without permission of the user in advance, except in the following cases.

①	Required by law
②	Necessary for protection of human life, body, or assets and it is difficult to obtain permission from the said person
③	Especially necessary for improvement of public health or promotion of sound growth of children and it is difficult to obtain permission from the said person
④	Necessary to cooperate with performance of affairs required for a person designated by a national institution, local public organization and obtaining permission from the said person may hinder performance of such matters
⑤	When any of the following is notified or publicized in advance a. To include provision to a third party in the purpose of use b. Items of data to be provided to a third party c. Means or method of provision to a third party d. To suspend provision of personal data to a third party by request of the said person

Irrespective of above stipulation, the following cases shall not be construed as a third party.

①	Our hotel outsources the whole or a part of handling of personal data within the limit necessary to complete the purpose of use
②	Personal data is provided following succession of the business due to merger or other causes
③	When the personal data is used jointly with a specified party and relevant information is notified to the said person in advance to let him/ her know in ,easy manner of the situation e.g. the said fact, item of personal data to be jointly used, range of parties for the joint use, purpose of use of the users, name of the person or name of company in charge of control of personal data

Article 5. Disclosure of personal data

Our hotel shall disclose personal data without delay if requested by the said person. However, if this disclosure falls under any of the following, we may not disclose the whole or a part of such data and if we determined not to disclose it, we shall notify such decision without delay. We charge 1,000Yen per one disclosure of personal data.

①	It may damage the life, body, assets or other rights/ interests of the said person or a third party
②	It may cause extreme hindrance to the proper execution of our hotel business
③	It violates other relevant laws

Irrespective of the above stipulations, data other than the privacy data, e.g. history and characteristic information shall in principle not be disclosed by us.

Article 6. Revision and deletion of personal data

The user is able to request our hotel to revise or delete the personal data with the procedure specified by us if the personal data held by our hotel is wrong.
Our hotel shall correct or delete the personal data without delay and notify the user if we deem it necessary to accept and respond to the above request by the user.

Article 7. Suspension of use of personal data

If our hotel is required by the user to suspend the of use or deletion of the personal data ("suspension of use etc.") by reason that the personal data is used beyond the limits of the purpose of use, or it has been obtained through improper means, we shall conducts the necessary investigation without delay and carry out termination of use of the personal data and notify the said person as such. However, if such termination of use requires a large amount of expense or it is difficult to carry out and also an alternative measure can be implemented to protect the said person's rights and interests, such measure shall be implemented by us.

Article 8. Change in the privacy policy

We shall be able to change this privacy policy without any notice to the users.
The revised private policy as above shall become effective upon publication on our web site unless otherwise stipulated by our hotel.
